Description
Section 497 of the Indian Penal Code (IPC) deals with the offense of adultery. It addresses situations where a man engages in sexual intercourse with a married woman, without the consent of her husband, and without the knowledge of the husband.
Offense Definition (Section 497 IPC):
- Adultery: According to Section 497, adultery occurs when:
- A man has sexual intercourse with a married woman who is not his wife.
- The man must know that the woman is married, and the act of adultery must happen without the consent or knowledge of the woman's husband.
- The woman involved in the adultery is not treated as an offender in this section, and only the man who engages in the act is punished under this provision.
Punishment
Imprisonment: The punishment for adultery under Section 497 IPC is:- Imprisonment for a term which may extend to five years.
Fine: The offender may also be liable to pay a fine, or both imprisonment and fine.
