CrPC Section-18 - Special Metropolitan Magistrates

Description

The High Court, upon request from any Central or State Government, may confer upon any person who holds or has held a post under the Government, all or any of the powers granted or that may be granted by this Code to a Metropolitan Magistrate, in relation to specific cases or particular classes of cases within any metropolitan area under its jurisdiction.

Provided, however, that no such power shall be conferred upon a person unless they possess the qualifications or experience in legal matters as specified by the High Court through rules.

Such Magistrates shall be known as Special Metropolitan Magistrates and shall be appointed for a term not exceeding one year at a time, as directed by the High Court through general or special order.

The High Court or the State Government, as applicable, may authorize any Special Metropolitan Magistrate to exercise, within any local area outside the metropolitan area, the powers of a Judicial Magistrate of the First Class.
