Description
The Court of a Magistrate may impose a term of imprisonment for default in payment of a fine, as authorized by law. However, the following conditions apply:
- The term of imprisonment for default must not exceed the powers of the Magistrate under Section 29.
- Where imprisonment has already been awarded as part of the substantive sentence, the term for default of payment of the fine shall not exceed one-fourth of the term of imprisonment the Magistrate is competent to impose for the offence, aside from the imprisonment due to non-payment of the fine.
The imprisonment imposed under this section may be in addition to a substantive sentence of imprisonment, for the maximum term that the Magistrate is authorized to impose under Section 29.
