CrPC Section-40 - Duty of officers employed in connection with the affairs of a village to make certain report

Description

Every officer employed in connection with the affairs of a village and every person residing in a village is required to immediately communicate to the nearest Magistrate or to the officer in charge of the nearest police station any information they may have about:

  1. Residence of notorious criminals: The permanent or temporary residence of any notorious receiver or vendor of stolen property in or near the village.

  2. Suspicious individuals: Any person whom they know or reasonably suspect to be a thug, robber, escaped convict, or proclaimed offender who resorts to or passes through the village.

  3. Non-bailable offences: The commission or intention to commit any non-bailable offence or offences under sections 143, 144, 145, 147, or 148 of the Indian Penal Code (IPC).

  4. Suspicious deaths or disappearances: Any sudden or unnatural death, death under suspicious circumstances, discovery of a corpse or body parts, or the disappearance of a person under circumstances suggesting a non-bailable offence.

  5. Offences outside India: Any act which, if committed in India, would constitute an offence punishable under the following sections of the IPC:

    • Sections 231 to 238 (inclusive), 302, 304, 382, 392-399 (inclusive), 402, 435, 436, 449, 457-460 (inclusive), 489A, 489B, 489C, and 489D.
  6. Matters affecting public order: Any other information likely to affect public order, crime prevention, or the safety of persons or property that the District Magistrate has specifically ordered to be reported.


Definitions:

  • "Village" includes village lands.
  • "Proclaimed offender": Any person proclaimed as an offender by any court or authority in territories to which this Code does not extend, for an offence which would be punishable under the Indian Penal Code if committed in territories covered by this Code.
  • "Officer employed in connection with the affairs of the village": This includes any member of the village panchayat, the headman, and any officer or person appointed for the administration of the village.
