CrPC Section-68 - Proof of service in such cases and when serving officer not present
Description
- When a summons issued by a Court is served outside its local jurisdiction, and in cases where the officer who served the summons is not present at the hearing, an affidavit—sworn before a Magistrate—stating that the summons has been served, along with a duplicate of the summons bearing the endorsement (as required under section 62 or section 64) from the person to whom it was delivered, tendered, or left with, shall be admissible as evidence. The statements in the affidavit will be considered correct unless proven otherwise.
- The affidavit may be attached to the duplicate of the summons and returned to the Court.
