CrPC Section-78 - Warrant forwarded for execution outside jurisdiction

Description

  1. When a warrant is to be executed outside the local jurisdiction of the Court issuing it, the Court may, rather than directing the warrant to a police officer within its jurisdiction, forward it by post or other means to any Executive Magistrate, District Superintendent of Police, or Commissioner of Police within the jurisdiction where it is to be executed. Upon receiving the warrant, the Executive Magistrate, District Superintendent, or Commissioner shall endorse their name on it and, if practicable, ensure it is executed as outlined in the previous provisions.
  2. The Court issuing the warrant, under Sub-Section (1), shall also send, along with the warrant, the substance of the information against the person to be arrested, together with any relevant documents necessary for the Court acting under Section 81 to determine whether bail should be granted.
