SrCP Section-79 - Warrant directed to police officer for execution outside jurisdiction

Description

  1. When a warrant directed to a police officer is to be executed outside the local jurisdiction of the Court issuing it, the police officer shall generally present the warrant for endorsement to an Executive Magistrate or a police officer of at least the rank of an officer in charge of a police station, within whose local jurisdiction the warrant is to be executed.
  2. The Magistrate or police officer, upon receiving the warrant, shall endorse their name on it, and this endorsement shall serve as sufficient authority for the police officer to execute the warrant. The local police shall, if necessary, assist the officer in executing the warrant.
  3. If there is reason to believe that obtaining the endorsement from the Magistrate or police officer within the jurisdiction of the execution will cause a delay that could hinder the execution of the warrant, the police officer to whom the warrant is directed may proceed with the execution without such endorsement, in any place beyond the local jurisdiction of the Court that issued the warrant.
