CrPC Section-101 - Disposal of things found in search beyond jurisdiction
Description
Execution of Search Warrant Beyond Local Jurisdiction:
If a search warrant is executed at a place outside the local jurisdiction of the Court that issued it, and if any items related to the search are found:
- These items, along with the list of items prepared during the search, must be immediately taken before the Court that issued the warrant.
If the place is closer to a Magistrate who has jurisdiction over that area, rather than the Court that issued the warrant:
- The list and items must be immediately taken before that Magistrate.
- Unless there is a valid reason to the contrary, the Magistrate will then issue an order allowing the items to be taken to the Court that issued the search warrant.
