Description

Execution of Search Warrant Beyond Local Jurisdiction:

1. If a search warrant is executed at a place outside the local jurisdiction of the Court that issued it, and if any items related to the search are found:

   • These items, along with the list of items prepared during the search, must be immediately taken before the Court that issued the warrant.

2. If the place is closer to a Magistrate who has jurisdiction over that area, rather than the Court that issued the warrant:

   • The list and items must be immediately taken before that Magistrate.
   • Unless there is a valid reason to the contrary, the Magistrate will then issue an order allowing the items to be taken to the Court that issued the search warrant.
