CrPC Section-105A - Definitions

Description

  • "Contracting State" refers to any country or territory outside India where arrangements have been established by the Central Government through a treaty or other agreements with the government of that country or territory.
  • "Identifying" includes establishing proof that the property was obtained from, or used in, the commission of an offence.
  • "Proceeds of Crime" means any property, whether directly or indirectly, derived or obtained by any person as a result of criminal activity, including crimes related to currency transfers, or the value of such property.
  • "Property" encompasses all types of property and assets, whether corporeal or incorporeal, movable or immovable, tangible or intangible. It also includes deeds and instruments that demonstrate title to or interest in such property or assets that have been derived from or used in the commission of an offence, as well as property obtained through proceeds of crime.
  • "Tracing" refers to determining the nature, source, movement, title, ownership, or disposition of property.
