CrPC Section-105C - Assistance in relation to orders of attachment or forfeiture of property

Description

(1) If a Court in India has reasonable grounds to believe that any property obtained by a person has been derived or obtained, directly or indirectly, from the commission of an offence, the Court may issue an order for the attachment or forfeiture of such property as it deems appropriate, in accordance with the provisions of Sections 105D to 105J (both inclusive).

(2) If the Court has issued an order for attachment or forfeiture of property under Sub-section (1), and the property is suspected to be located in a contracting State, the Court may issue a letter of request to a Court or authority in that contracting State for the execution of the order.

(3) If the Central Government receives a letter of request from a Court or authority in a contracting State, requesting the attachment or forfeiture of property located in India that has been derived or obtained, directly or indirectly, from the commission of an offence in that contracting State, the Central Government may forward the letter of request to the appropriate Court for execution. This execution will be in accordance with the provisions of Sections 105D to 105J (both inclusive) or any other applicable law in force.
