If the person against whom such an order is issued is not present in Court, the Magistrate shall issue a summons requiring them to appear. If the person is in custody, the Magistrate shall issue a warrant directing the officer in charge to bring them before the Court.
However, if the Magistrate, based on a police report or other recorded information, has reason to believe that a breach of the peace is imminent and cannot be prevented except through the immediate arrest of the person, they may issue a warrant for the person’s arrest at any time.
