If, upon an inquiry under Section 116, it is not proven that executing a bond is necessary for maintaining peace or ensuring good behavior, the Magistrate shall record this finding in the case records. If the person is in custody solely for the purposes of the inquiry, they shall be released. If the person is not in custody, they shall be discharged.
