CrPC Section-129 - Dispersal of assembly by use of civil force

Description

Dispersal of Unlawful Assemblies

  1. Authority to Command Dispersal:
    Any Executive Magistrate, officer in charge of a police station, or, in the absence of such an officer, any police officer not below the rank of sub-inspector may order the dispersal of:

    • Any unlawful assembly, or
    • Any assembly of five or more persons likely to disturb public peace.

    Upon such a command, it shall be the duty of the members of the assembly to disperse immediately.

  2. Use of Force for Dispersal:

    • If the assembly fails to disperse after being commanded, or
    • If it demonstrates an intent not to disperse, even without a command,

    The Executive Magistrate or police officer may disperse the assembly by force. They may also:

    • Seek assistance from any male civilian (excluding members of the armed forces).
    • Arrest and detain individuals forming part of the assembly to ensure its dispersal and potential legal action.
