CrPC Section-130 - Use of armed forces to disperse assembly

Description

If an assembly cannot be dispersed by other means, and if public security requires its dispersal, the highest-ranking Executive Magistrate present may order its dispersal by the armed forces.

  1. The Magistrate may direct any officer in command of a unit of the armed forces to:

    • Disperse the assembly using the forces under his command.
    • Arrest and detain individuals forming part of the assembly, as directed by the Magistrate or as necessary to enforce dispersal and legal action.
  2. The officer in command of the armed forces shall comply with such orders, but must:

    • Use minimum necessary force to achieve dispersal.
    • Ensure that harm to persons and property is minimized while enforcing the order.
