CrPC Section-131 - Power of certain armed force officers to disperse assembly

Description

If public security is manifestly endangered by an unlawful assembly and no Executive Magistrate is available, any commissioned or gazetted officer of the armed forces may:

  • Disperse the assembly using the forces under his command.
  • Arrest and detain individuals forming part of the assembly to ensure dispersal and legal action.

However, if communication with an Executive Magistrate becomes possible while acting under this provision, the officer must establish contact and thereafter follow the Magistrate’s instructions regarding whether to continue or cease such action.
