Authority to Act:
Whenever a District Magistrate, Sub-Divisional Magistrate, or any other Executive Magistrate specially empowered by the State Government receives a report from a police officer or other information, and after considering any necessary evidence, believes that action is required in any of the following circumstances:
Issuance of a Conditional Order:
The Magistrate may issue a conditional order requiring the responsible person (causing the obstruction, owning the property, or possessing the hazardous item) to take appropriate action within a specified time. The order may direct the person to:
Alternatively, if the individual objects to compliance, they must appear before the Magistrate (or a subordinate Executive Magistrate) at the specified time and place to show cause why the order should not be made absolute.
Finality of the Order:
No order duly made by a Magistrate under this section shall be challenged in any civil court.
