CrPC Section-138 - Procedure where he appears to show cause

Description

  1. If a person against whom an order under Section 133 has been issued appears and presents objections, the Magistrate shall conduct an inquiry by taking evidence as in a summons case.
  2. If, after considering the evidence, the Magistrate finds that the order is reasonable and proper, either in its original form or with necessary modifications, the order shall be made absolute accordingly.
  3. However, if the Magistrate is not satisfied with the necessity or reasonableness of the order, no further proceedings shall be taken in the case.
