CrPC Section-141 - Procedure on order being made absolute and consequences of disobedience
Description
Notice to the Person Concerned
- When an order is made absolute under Section 136 or Section 138, the Magistrate shall notify the person against whom the order was issued.
- The notice will specify the time frame within which the required act must be performed.
- It will also inform the person that failure to comply may result in penalties under Section 188 of the Indian Penal Code (45 of 1860).
Enforcement of the Order
- If the person fails to comply within the specified time, the Magistrate may arrange for the act to be performed.
- The costs incurred in executing the order may be recovered through:
a) Sale of removed property (e.g., buildings or goods removed under the order).
b) Distress and sale of other movable property belonging to the person, either within or outside the Magistrate's jurisdiction.
c) Attachment and sale of property in another jurisdiction if endorsed by the Magistrate where the property is located.
Protection from Legal Action
- No legal suit shall be entertained against any action taken in good faith under this section.
