CrPC Section-155 - Information as to non-cognizable cases and investigation of such cases
Description
Recording Information
- When information regarding the commission of a non-cognizable offence within the jurisdiction of a police station is provided to the officer in charge, the officer shall:
a) Record the substance of the information in a designated register, as prescribed by the State Government.
b) Refer the informant to the Magistrate for further action.
Investigation Restrictions
- A police officer cannot investigate a non-cognizable case without prior approval from a Magistrate who has the authority to try the case or commit it for trial.
Powers After Magistrate’s Approval
- Upon receiving an order from the Magistrate, the police officer may exercise the same investigative powers as applicable in cognizable cases, except for the power to arrest without a warrant.
Mixed Cases (Cognizable & Non-Cognizable Offences)
- If a case involves both cognizable and non-cognizable offences, it shall be treated as a cognizable case, ensuring that the police can investigate without prior approval from a Magistrate.
