CrPC Section-161 - Examination of witnesses by police

Description

  1. Any police officer conducting an investigation under this Chapter, or any police officer of a rank prescribed by the State Government through a general or special order, may orally examine any person believed to have knowledge of the facts and circumstances of the case.

  2. Such person is obligated to answer all questions truthfully, except those that might incriminate him or expose him to a penalty or forfeiture.

  3. The police officer may reduce any statement made during the examination into writing, ensuring that a separate and accurate record is maintained for each individual statement.

  4. Additional Provisions:

    • Statements may also be recorded using audio-video electronic means.
    • If the statement pertains to a woman victim of offences under Sections 354, 354A, 354B, 354C, 354D, 376, 376A, 376B, 376C, 376D, 376E, or 509 of the Indian Penal Code, it must be recorded by a woman police officer or any woman officer.
