Key Forms in Appendix B:

1. Form 1 - Summons to Defendant:

  • Form 1 is used to issue a summons to the defendant to appear in court. This form outlines the details of the case, the court where the case is being heard, and the date on which the defendant must appear.
  • A summons is the formal notice that begins the court’s involvement in a case and informs the defendant of the legal action being taken against them.

2. Form 2 - Summons for Settlement of Issues (for Specific Relief or Other Proceedings):

  • This form is used when the court issues a summons for the settlement of issues in a case, which happens when the issues (disputed questions of law or fact) need to be settled before the trial begins.
  • It may be issued in cases where preliminary objections are raised, or specific relief is sought.

3. Form 3 - Notice of Application:

  • Form 3 is used for serving a notice to a party when an application (such as an interim order, injunction, or other legal relief) has been filed in the court.
  • The notice specifies the time, date, and nature of the application and requires the party to respond or appear in court.

4. Form 4 - Warrant of Arrest:

  • Form 4 provides the format for a warrant of arrest. It is issued when a party has failed to comply with a court order, such as failing to attend court hearings or failing to pay the debt as ordered by the court.
  • The warrant authorizes the police to arrest the individual and bring them to court.

5. Form 5 - Warrant of Attachment (for Property):

  • This form is used for the attachment of property. If a judgment is passed in favor of the plaintiff, and the defendant fails to satisfy the judgment, the court may issue a warrant of attachment to seize the defendant’s property.
  • The attached property can later be sold to satisfy the judgment.

6. Form 6 - Warrant for Sale of Attached Property:

  • Once the property is attached, the warrant for sale is issued to sell the property in order to recover the amount due to the plaintiff under the court's decree.

7. Form 7 - Notice to Show Cause:

  • This form is used to issue a notice to show cause why a specific action or order should not be taken by the court.
  • For example, it could be used when a party is asked to explain why an attachment or other measure should not proceed.

8. Form 8 - Subpoena for Witness:

  • Form 8 is used to issue a subpoena for a witness to attend the court and provide testimony. This is required to compel a person to appear as a witness and give evidence on behalf of the party who requested the subpoena.

9. Form 9 - Notice of Execution:

  • Form 9 provides the format for a notice of execution, which is issued when a judgment has been passed and the execution process for enforcing the judgment begins.
  • It informs the judgment debtor that the court will take action to enforce the decree.

Punishment

While Appendix B itself does not specify punishments, there are certain legal consequences that can arise in relation to the process forms:

  1. Failure to Comply with Summons or Court Orders:

    • If a defendant or any party fails to comply with the summons or court orders issued through the process forms, they may be subject to legal consequences such as default judgment or attachment of property.
  2. Contempt of Court:

    • If a party deliberately disobeys a court order, including failure to comply with a warrant of arrest or warrant of attachment, they can be held in contempt of court, which may result in penalties, fines, or imprisonment.
  3. Attachment of Property:

    • Failure to comply with the court’s decree may lead to the attachment of property, which can be enforced through a warrant of attachment.
