Description
1. Requesting Another Police Station to Conduct a Search
- A police officer in charge of a station or an investigating officer (not below Sub-Inspector rank) may request another police station (even in a different district) to conduct a search.
- The requested officer must follow the procedure under Section 165.
- Any items found during the search shall be sent to the requesting officer.
2. Conducting an Urgent Search in Another Jurisdiction
If there is a risk that evidence may be concealed or destroyed due to the delay in making a request, the investigating officer may:
- Conduct the search directly in another police station’s jurisdiction.
- Follow the same rules as if the place were within his own jurisdiction (as per Section 165).
3. Notifications & Record Submission
- An officer conducting a direct search in another jurisdiction must:
- Notify the officer in charge of the police station within whose jurisdiction the search took place.
- Send a copy of the search list (prepared under Section 100) along with the notice.
- Forward copies of all search records to the nearest Magistrate with the authority to take cognizance of the offence.
4. Rights of the Owner/Occupier
- The owner or occupier of the searched premises is entitled to a free copy of the search records sent to the Magistrate, upon request.
