CrPC Section-166B - Letter of request from a country or place outside India to a Court or an authority for investigation in India

Description

Upon receiving a Letter of Request from a competent Court or authority outside India for the examination of a person or the production of documents or objects related to an offence under investigation in that country, the Central Government may, if deemed appropriate:

  1. Forward the request to the Chief Metropolitan Magistrate, Chief Judicial Magistrate, or any Metropolitan/Judicial Magistrate appointed for this purpose. The Magistrate shall then:

    • Summon the person and record their statement.
    • Require the production of the requested document or object.
  2. Send the request to a police officer for investigation, who shall proceed as if the offence had been committed within India.

All evidence collected, authenticated copies of documents, or objects obtained under this section shall be forwarded by the Magistrate or police officer to the Central Government, which shall then transmit them to the requesting authority in a manner it deems appropriate.
