CrPC Section-170 - Cases to be sent to Magistrate when evidence is sufficient

Description

**"If, during an investigation under this Chapter, the officer in charge of the police station determines that there is sufficient evidence or reasonable ground to proceed, the officer shall forward the accused in custody to a Magistrate empowered to take cognizance of the offence upon a police report and to either try the accused or commit them for trial. However, if the offence is bailable and the accused is able to provide security, the officer shall take security for the accused’s appearance before the Magistrate on a specified date and for continued attendance until otherwise directed.

When forwarding the accused to the Magistrate or taking security for their appearance, the officer shall also send any weapons or articles necessary to be produced as evidence. Additionally, the officer shall require the complainant (if any) and such persons acquainted with the facts of the case, as deemed necessary, to execute a bond for their appearance before the Magistrate to prosecute or give evidence as required.

If the bond mentions the Court of the Chief Judicial Magistrate, it shall also be deemed to include any Court to which the Magistrate refers the case for inquiry or trial, provided reasonable notice of such referral is given to the complainant or witnesses.

The officer before whom the bond is executed shall provide a copy to one of the executors and forward the original bond along with his report to the Magistrate."**
