CrPC Section-187 - Power to issue summons or warrant for offence committed beyond local jurisdiction

Description

If a Magistrate of the first class has reason to believe that a person within his local jurisdiction has committed an offence outside such jurisdiction (whether within or outside India) that cannot be inquired into or tried within his jurisdiction under sections 177 to 185 or any other law but is still triable in India, the Magistrate may:

  • Inquire into the offence as if it had been committed within his jurisdiction.
  • Compel the accused to appear before him.
  • Send the accused to the Magistrate having jurisdiction to inquire into or try the offence.
  • If the offence is not punishable with death or life imprisonment, and the accused is willing to give bail, the Magistrate may take a bond with or without sureties for the accused's appearance before the appropriate Magistrate.

If there are multiple Magistrates with jurisdiction and the Magistrate under this section is uncertain about which Magistrate should handle the case, the matter shall be reported to the High Court for a decision.
