CrPC Section-190 - Cognizance of offences by Magistrates

Description

Subject to the provisions of this Chapter, the following Magistrates may take cognizance of any offence:

  1. Any Magistrate of the first class
  2. Any Magistrate of the second class, if specially empowered under Sub-Section (2)

They may take cognizance in the following ways:

  • Upon receiving a complaint of facts that constitute the offence
  • Upon a police report of such facts
  • Upon information received from any person other than a police officer
  • Upon their own knowledge that such offence has been committed
