CrPC Section-198A - Prosecution of offences under section 498A of the Indian Penal Code

Description

General Rule

No Court shall take cognizance of an offence punishable under Section 498A of the Indian Penal Code (IPC), 1860 except:

  1. Upon a police report detailing the facts constituting the offence, or
  2. Upon a complaint made by:
    • The aggrieved woman herself, or
    • Her father, mother, brother, or sister, or
    • Her father's or mother's brother or sister, or
    • Any other person related to her by blood, marriage, or adoption, but only with the Court’s permission.
