CrPC Section-201 - Procedure by Magistrate not competent to take cognizance of the case

Description

If a complaint is made to a Magistrate who is not competent to take cognizance of the offence, they must:

  1. If the Complaint is in Writing

    • Return the complaint to the complainant.
    • Endorse on it a direction that it should be presented to the proper Court.
  2. If the Complaint is Not in Writing

    • Direct the complainant to approach the appropriate Court that has jurisdiction over the matter.
