Description
"In cases where proceedings are instituted based on a police report, the Magistrate shall, without delay and free of cost, provide the accused with copies of the following:
- The police report.
- The first information report recorded under Section 154.
- Statements recorded under Sub-Section (3) of Section 161 of all prosecution witnesses, except parts excluded upon a police officer's request under Sub-Section (6) of Section 173.
- Any confessions or statements recorded under Section 164.
- Any other document or relevant extract submitted to the Magistrate with the police report under Sub-Section (5) of Section 173.
Provisions:
- If the Magistrate reviews an excluded portion of a statement (as per clause iii) and finds it appropriate, they may order that a copy of the relevant portion be provided to the accused.
- If any document under clause (v) is deemed voluminous, the Magistrate may allow the accused to inspect it in court, personally or through a pleader, instead of furnishing a copy.
