CrPC Section-207 - Supply to the accused of copy of police report and other documents

Description

"In cases where proceedings are instituted based on a police report, the Magistrate shall, without delay and free of cost, provide the accused with copies of the following:

  1. The police report.
  2. The first information report recorded under Section 154.
  3. Statements recorded under Sub-Section (3) of Section 161 of all prosecution witnesses, except parts excluded upon a police officer's request under Sub-Section (6) of Section 173.
  4. Any confessions or statements recorded under Section 164.
  5. Any other document or relevant extract submitted to the Magistrate with the police report under Sub-Section (5) of Section 173.

Provisions:

  • If the Magistrate reviews an excluded portion of a statement (as per clause iii) and finds it appropriate, they may order that a copy of the relevant portion be provided to the accused.
  • If any document under clause (v) is deemed voluminous, the Magistrate may allow the accused to inspect it in court, personally or through a pleader, instead of furnishing a copy.
