CrPC Section-210 - Procedure to be followed when there is a complaint case and police investigation in respect of the same offence

Description

"In a case instituted otherwise than on a police report (hereinafter referred to as a complaint case), if it appears to the Magistrate during the inquiry or trial that a police investigation is ongoing regarding the same offence, the Magistrate shall:

  1. Stay the inquiry or trial and request a report from the investigating police officer.
  2. If the police submit a report under Section 173 and the Magistrate takes cognizance of an offence against any accused in the complaint case, both the complaint case and the case arising from the police report shall be inquired into or tried together as if both were instituted on a police report.
  3. If the police report does not relate to any accused in the complaint case or if the Magistrate does not take cognizance of any offence from the police report, the stayed inquiry or trial shall continue as per the provisions of this Code
