Description
"Every charge under this Code shall specify the offence with which the accused is charged.
- If the law defining the offence assigns it a specific name, the charge may refer to the offence by that name alone.
- If no specific name is given, the charge must include enough of the offence's definition to inform the accused of the nature of the charge.
- The charge shall mention the relevant law and section under which the offence is alleged to have been committed.
- Filing a charge implies that all legal conditions necessary to constitute the offence were met in the given case.
- The charge must be written in the language of the Court.
- If the accused has a prior conviction that makes them liable for enhanced or different punishment for a subsequent offence, and the prosecution intends to prove such prior conviction, the charge shall include the fact, date, and place of the previous conviction. If omitted initially, the Court may add this information at any time before sentencing.
