Description
"Any Court may alter or add to a charge at any time before judgment is pronounced.
- Every such alteration or addition shall be read and explained to the accused.
- If the alteration or addition does not prejudice the accused in their defense or the prosecutor in conducting the case, the Court may proceed with the trial as if the modified charge were the original charge.
- If the alteration or addition is likely to cause prejudice to either the accused or the prosecutor, the Court may either order a new trial or adjourn the trial for an appropriate period.
- If the altered or added charge involves an offence requiring prior sanction for prosecution, the trial shall not proceed until such sanction is obtained, unless it has already been granted for prosecution based on the same facts.
