CrPC Section-223 - What persons may be charged jointly

Description

The following categories of individuals may be jointly charged and tried:

  1. Persons accused of the same offence committed in the course of the same transaction.
  2. Persons accused of an offence, along with those accused of abetment or attempt to commit that offence.
  3. Persons accused of multiple offences of the same kind (as per Section 219) committed jointly within a period of twelve months.
  4. Persons accused of different offences committed in the course of the same transaction.
  5. Persons involved in offences related to property—such as theft, extortion, cheating, or misappropriation—and those accused of receiving, retaining, disposing of, or concealing such property, or abetting or attempting these offences.
  6. Persons accused under Sections 411 and 414 of the Indian Penal Code (IPC) regarding stolen property transferred through an offence.
  7. Persons involved in counterfeit currency offences (Chapter XII of IPC), including those who committed related offences concerning the same coin, or abetted or attempted such offences.
