Description
When multiple charges are framed against the same person and a conviction has been secured for one or more of them, the following may occur:
- The complainant or prosecuting officer, with the Court’s consent, may withdraw the remaining charges.
- The Court may, on its own, stay the inquiry or trial for the remaining charges.
Effects of Withdrawal:
- Such withdrawal shall be deemed an acquittal on the withdrawn charges.
- However, if the conviction is set aside, the Court (subject to any higher Court’s order) may resume the inquiry or trial of the previously withdrawn charges.
