CrPC Section-227 - Discharge
Description
Judge’s Evaluation:
- The Judge must review the case record and the documents submitted.
- Both the prosecution and the accused get a chance to present their arguments.
Decision on Sufficiency of Grounds:
- If the Judge finds that there is not sufficient ground to proceed with the trial, the accused is discharged.
- The Judge must record reasons for the discharge.
Purpose:
- This prevents frivolous or baseless cases from proceeding to trial.
- Protects individuals from unnecessary prosecution when there isn’t enough evidence.
