CrPC Section-242 - Evidence for prosecution

Description

  1. If the accused refuses to plead, does not plead, claims to be tried, or if the Magistrate does not convict the accused under Section 241, the Magistrate shall set a date for the examination of witnesses.
  2. Upon the prosecution’s application, the Magistrate may issue a summons requiring any witness to appear or to produce any relevant document or material.
  3. On the appointed date, the Magistrate shall proceed with recording all evidence presented in support of the prosecution.
  4. Provided that the Magistrate may allow the cross-examination of a witness to be deferred until other witnesses have been examined or may recall any witness for further cross-examination.
