CrPC Section-245 - When accused shall be discharged

Description

If, after considering all the evidence presented under section 244, the Magistrate determines that no case has been established against the accused that would warrant conviction if left unrebutted, the Magistrate shall discharge the accused, recording the reasons for doing so.

Nothing in this section prevents the Magistrate from discharging the accused at an earlier stage if the charge is deemed groundless, provided the reasons for such a decision are recorded.
