If the Magistrate does not convict the accused under Section 252 or Section 253, he shall proceed to hear the prosecution and consider all evidence presented in support of the case. Likewise, he shall also hear the accused and examine any evidence produced in his defense. The Magistrate may, at his discretion, issue a summons—upon request from either the prosecution or the accused—directing any witness to attend or produce relevant documents or other material. Before summoning a witness, the Magistrate may require that reasonable expenses incurred by the witness for attending the trial be deposited in the Court.
