CrPC Section-255 - Acquittal or conviction

Description

If, upon considering the evidence referred to in Section 254, along with any additional evidence the Magistrate may introduce on his own motion, he finds the accused not guilty, he shall record an order of acquittal. However, if the Magistrate does not act under Section 325 or Section 360 and finds the accused guilty, he shall impose a sentence in accordance with the law. Additionally, under Section 252 or Section 255, the Magistrate may convict the accused of any offence triable under this Chapter if, based on the admitted or proven facts, the offence appears to have been committed, provided that such conviction does not prejudice the accused.
