Description
"If the offence be not of any of the descriptions enumerated in the last preceding section, the right of private defence of the body does not extend to the voluntary causing of death to the assailant, but does extend, under the restrictions mentioned in section 99, to the voluntary causing to the assailant of any harm other than death."
This section states that:
- If the attack does not create a reasonable apprehension of death or grievous hurt, the defender CANNOT cause the death of the attacker.
- However, the person CAN use necessary force to cause any harm other than death to stop the attack and protect themselves.
- The use of force must still follow the restrictions mentioned in Section 99 IPC, which include:
- No excessive force beyond what is necessary for self-defense.
- No retaliation or revenge after the attack is over.
- No self-defense against lawful actions of public servants.

Self-defense is allowed, but killing is not justified
- A person can use force to protect themselves, but if the attack does not threaten life or serious injury, they cannot take the attacker’s life.
Force should be proportional to the danger faced
- The degree of force used in self-defense must be reasonable and necessary.
- If a person punches or slaps another in an argument, the victim cannot justify killing them under self-defense.
Harm other than death is permitted
- The defender can push, punch, hit, or even injure the attacker, but they cannot go beyond that to cause death.
- If the attacker stops the assault, the defender must also stop and cannot continue attacking.
Self-defense applies to various non-lethal situations
- This section applies when someone is facing an attack that does not pose a life-threatening danger, such as:
- Minor physical fights (pushing, slapping, fistfights).
- Verbal threats or intimidation without immediate action.
- Attacks with non-lethal weapons, like sticks or fists.
