Description
When negotiating a mutually satisfactory resolution under Section 265B(4)(a), the Court shall follow these procedures:
For Cases Instituted on a Police Report:
- The Court shall issue notice to:
- The Public Prosecutor
- The Investigating Police Officer
- The Accused
- The Victim
- All parties shall participate in a meeting to work out a satisfactory resolution.
- Court’s Duty:
- Ensure that the entire process is completed voluntarily.
- Accused’s Right:
- If desired, the accused may participate with his pleader (defense lawyer).
For Cases Instituted Otherwise Than on a Police Report:
- The Court shall issue notice to:
- Both parties shall participate in a meeting to work out a satisfactory resolution.
- Court’s Duty:
- Ensure the entire process remains voluntary.
- Right to Legal Representation:
- If the victim or accused desires, they may participate with their pleader (lawyer).
