CrPC Section-265E - Disposal of the case

Description

When a satisfactory disposition of the case has been reached under Section 265D, the Court shall dispose of the case as follows:

  1. Awarding Compensation to the Victim

    • The Court shall grant compensation to the victim as agreed upon in the disposition.
    • The Court shall also hear the parties regarding:
      • The quantum of punishment for the accused.
      • Whether the accused may be released on probation for good conduct or after admonition under:
        • Section 360 of CrPC, or
        • The Probation of Offenders Act, 1958, or
        • Any other applicable law.
  2. Probation or Release Under Special Laws

    • If the Court believes that Section 360 or the Probation of Offenders Act applies, it may release the accused on probation or grant any benefits under such laws.
  3. Reduction of Minimum Punishment

    • If a minimum punishment is prescribed by law for the offence, the Court may sentence the accused to half of the minimum punishment.
  4. Reduction of General Punishment

    • If the offence is not covered under the above categories, the Court may sentence the accused to one-fourth of the prescribed or extendable punishment.
