**"If, during any inquiry, trial, or proceeding under this Code, a Magistrate's Court determines that the examination of a witness is essential for justice, but securing their attendance would cause unreasonable delay, expense, or inconvenience, the Court may dispense with their presence and issue a commission for their examination in accordance with this Chapter.
Provided that if the witness is the President or Vice-President of India, the Governor of a State, or the Administrator of a Union Territory, a commission shall be mandatorily issued for their examination.
Additionally, when issuing a commission for a prosecution witness, the Court may direct that a reasonable amount be paid by the prosecution to cover the accused's expenses, including pleader’s fees."**
