Description
Authority to Visit and Inspect Locations:
- At any stage of an inquiry, trial, or other proceeding, the Judge or Magistrate may visit and inspect any place where an offense is alleged to have occurred, or any other place deemed necessary for better understanding or appreciating the evidence presented in the case.
Notice to Parties:
- The Judge or Magistrate must give due notice to the parties involved in the case (such as the prosecution, defense, or complainant) before making such a visit.
Recording of Observations:
- After the inspection, the Judge or Magistrate must record a memorandum of any relevant facts observed during the visit.
- This memorandum must be done without unnecessary delay and will become part of the official record of the case.
Access to the Memorandum:
- If any party (such as the prosecutor, complainant, accused, or other relevant parties) requests, they are entitled to receive a copy of the memorandum free of cost.
