CrPC Section-311A - Power of Magistrate to order person to give specimen signature or handwriting
Description
This section addresses two distinct aspects:
Specimen Signatures or Handwriting:
- If a Magistrate of the First Class believes it is necessary for the investigation or proceeding, they can direct a person (including an accused) to provide specimen signatures or handwriting.
- The person must appear at the specified time and place to give the specimen.
- Condition: This order can only be made if the person has already been arrested in connection with the investigation or proceeding. This ensures that the request for specimen signatures or handwriting is tied to a legal process where the person is under investigation or trial.
Payment of Expenses for Complainants and Witnesses:
- Criminal Courts have the discretion to order the Government to pay the reasonable expenses of a complainant or witness attending an inquiry, trial, or other legal proceedings.
- The State Government may create rules to regulate the payment of such expenses.
- This ensures that individuals who are required to appear in court do not face undue financial hardship for participating in the legal process.
