If a person is detained under the provisions of Sub-Section (2) of section 330 or section 335, and the Inspector-General or the visitors certify that, in their judgment, the person may be released without danger of harm to himself or others, the State Government may order his release, detention, or transfer to a public lunatic asylum if he has not already been sent there. In the case of a transfer to an asylum, the State Government may appoint a Commission consisting of a judicial officer and two medical officers.
This Commission shall conduct a formal inquiry into the person’s mental state, take any necessary evidence, and submit a report to the State Government, which may then decide to release or detain the person as it sees fit.
