CrPC Section-354 - Language and contents of judgment
Description
- "Except as expressly provided by this Code, every judgment referred to in section 353:
- Shall be written in the language of the Court.
- Shall contain the points for determination, the decision, and the reasons for the decision.
- Shall specify the offence (if any) of which the accused is convicted, the section of the Indian Penal Code (45 of 1860) or other law under which the conviction falls, and the punishment awarded.
- If the judgment is one of acquittal, it shall state the offence of which the accused is acquitted and direct that they be set at liberty.
- If there is doubt as to which section or part of the Indian Penal Code the offence falls under, the Court shall specify this and pass judgment in the alternative.
- If the conviction is for an offence punishable with death, or with imprisonment for life or a term of years, the judgment shall provide reasons for the sentence. In the case of a death sentence, special reasons must be provided.
- If the conviction is for an offence punishable by imprisonment for a term of one year or more, but the Court imposes a sentence of less than three months, the reasons for the sentence shall be recorded unless it is a sentence of imprisonment until the Court rises or the case was tried summarily under this Code.
- When a person is sentenced to death, the sentence shall direct that they be hanged by the neck until dead.
- Every order under section 117 or Sub-Section (2) of section 138, and every final order under sections 125, 145, or 147, shall contain the points for determination, the decision, and the reasons for the decision."
