Whenever a complaint regarding a non-cognizable offence is made to a Court, and if the accused is convicted, the Court may, in addition to the penalty imposed, order the accused to pay to the complainant the costs incurred in the prosecution, either in full or in part. The Court may also order that if the accused fails to pay the costs, they shall suffer simple imprisonment for a period not exceeding thirty days. Such costs may include reasonable expenses incurred for process fees, witness fees, and pleader's fees, as determined by the Court.
An order under this section may also be issued by an Appellate Court, the High Court, or the Court of Session when exercising its revision powers.
