CrPC Section-367 - Power to direct further inquiry to be made or additional evidence to be taken

Description

If, upon reviewing the proceedings, the High Court believes that further inquiry should be conducted or additional evidence should be presented regarding any point concerning the guilt or innocence of the convicted person, it may either conduct the inquiry or take the evidence itself, or direct the Court of Session to do so. Unless the High Court directs otherwise, the convicted person's presence may be waived during such inquiry or evidence gathering. When the inquiry or evidence is not directly handled by the High Court, the outcome of such actions shall be certified to the Court of Session.
