CrPC Section-406 - Power of Supreme Court to transfer cases and appeals

Description

"Whenever it appears to the Supreme Court that an order under this section is necessary for the ends of justice, it may direct the transfer of a particular case or appeal from one High Court to another, or from a Criminal Court subordinate to one High Court to an equivalent or superior Criminal Court subordinate to another High Court.

The Supreme Court may exercise this power only upon the application of the Attorney-General of India or an interested party. Every such application must be made by motion, which, except when the applicant is the Attorney-General of India or the Advocate-General of the State, must be supported by affidavit or affirmation.

If the Supreme Court dismisses an application for the exercise of these powers and considers it to be frivolous or vexatious, it may order the applicant to pay compensation, not exceeding one thousand rupees, to any person who opposed the application, as it deems appropriate in the circumstances."
